Zeppelin did it during the life of artists and without giving credit. They paid quite a bit for it as well. There is no legal case for infringing upon public domain...
Personally, I think ownership should pass down to and through the family in perpetuity...despite the obvious difficulties that would arise as time passes. There would always be someone claiming to be family and wanting ownership so they can profit from the art. But the lack of ownership is a huge part of why philharmonics and orchestras play classical music...they can do so freely. Commissioning a piece or playing a piece by a living composer is very expensive.
