Sorry if this has been answered already, but can someone explain why Dave and Friends shows haven’t (or won’t) see a release? All the info I can gather is that there’s “too much tied up in them” and I don’t really know what that means. Legally? If so, why?
You would think the other musicians would not only be ok with a release, but they would have had to contractually agree to one before going on tour.

I don’t get it.

They played a lot of cover songs. Any distribution would require some significant payouts for publishing rights. That’s probably the bigger issue than the artists playing on it.

There was a live release of the bonaroo set. look for that.

This is correct. I have no idea why anyone thinks that paying the band members would present any issues. Brady Blade will take any fucking money he can get from a Dave & Friends release and people like Trey, Tim and Dave are rich and don't care what recordings get released.

How much harder could that be than DMB management figuring out Led Zeppelin (Good Times Bad Times, Stairway), Sly & The Family Stone, Talking Heads, Pink Floyd, Neil Young, and God knows how many other covers they've released? It's not like the 2008 shows didn't have a solid amount of covers, they have 5 live releases from that year. I would assume at least every one of those has at least one cover in it. DMB used to edit Stairway's solo out of Watchtower live releases, right? And then they finally got it cleared to include it, yeah?

I feel like D&F wouldn't take that much to work to clear covers & work the money out. Some of those songs are already cleared by DMB anyway, like Thank You. If I am assuming incorrectly about how much money this would be or something, then I will gladly stand corrected.

It's not as complicated as all that. The cover songs would count as covers and because almost all of these had been covered and released by someone else already, it'd be a compulsory, industry set rate on all of these. There's nothing to to be figured out as far as the songs go.

My guess would be that they don't release them because it wasn't DMB or D&T OR that they just haven't explored the rights issues of the performers under that wonderful 'so-and-so appears courtesy of blah-blah records' clause. Not because it's hard or costly, but because it requires actually doing something more. I doubt Brady or Tony would have that issue, but possibly Trey might (I haven't looked into any of their contract structures, but a higher profile appearances can get weird on the back end). That's my suspicion on why The Nauts never materialized, but again never cared enough to look into it. OR Dave just doesn't want to chum the waters with Stefan. Not because he's afraid of what he'd do, but probably just doesn't want to hear it.

Others can speak to this better than I, but I think the covers enter a different legal realm when the package escalates to video, which is why Watchtower/Stairway on the Europe 2009 DVD is Watchtower-with-a-weird-midsong-cut

It can. Adding video generally does take it into weird territories. Depends on the placement, the prominence, and the performance. Most don't take it there for concerts partly because the likely return isn't great. "Stairway..." is one of those songs, though... I'm sure whoever holds the publishing exploits it to the fullest.

I want 9/15/06 with Bennie Cowan and Greg Thomas from P-Funk All-Stars. I know that gets into the weird 'appears courtesy of' deals that will probably stop them from being even investigated, but those guest spots were straight fire. All that is good is nasty
