In practice yes, but that's only because they monopolized that. All it would take is a 3rd party arbitrator.

Because some cases it’s the victims fault (going out driving when you can die by someone driving drunk) or it’s the drives fault cause they are negligent.

I missed that part, but yes, until the damage is caused no wrongdoing occurred.
