I forget the exact wording of the statute, but at the time he fired I don't believe it was reasonable for him to be in fear for his life. The guy was backing off. If he was advancing on him while he was on the ground, I'd say he had a better argument. He paused, watched the guy backing up, then shot him anyway. I'd say that's manslaughter.
