    haha yes i keep saying that it's fine that this is a "law" but it should not cost me an insane amount of money.

    especially considering i had a perfectly clean record until then.

    im on a strict budget here and now this is going to make things very difficult the entire year. thats what i am pissed about.

    Less than a speeding ticket, in mine. It certainly is less dangerous to walk around with an open container than it is to speed.

    It should absolutely have an impact on you financially. Its so you learn from it, which it sounds like you have.

    If the 250 is destroying your year, swing on down to McDonalds, and put in a few weekend shifts, and you'll be back to even.

    I know what its like to be "a broke college kid", and I know what its like to work full time and go to school.

    Its not easy, but its not supposed to be.

    Perhaps he includes it in this budget. Is it the best expense he has in his life? Clearly not, but the guy's in college, you go out, have a few drinks, be social, and make friends that you'll have the rest of your life.

    No one, aside from that one guy, is saying its not a part of your budget. I completely understand. Hell, I had a class that met weekly at a bar. I've had business ventures stem 5 years down the road from the guys I've had drinks with. Drinks are apart of the business world.

    Plus you need to unwind, have fun. I'm all for that, but you have to be responsible.

    You weren't, and it's going to cost you, as it should. You knew the law. You chose to break it, for whatever reason, and now, because of that choice, the rest of your semester is going to be pretty tough due to the new expense.

    Hopefully you'll make a better choice, financially and responsibly, next time.

    and thats what i do....i was on my way to a place where i can be social and drink casually...

    i brought a beer with me because beers at the bar are expensive as hell.

    is this whole budget thing starting to make sense now lol...?

    now i know i can't just stroll through town with a beer, but learning this lesson should maybe entail something different than a MASSIVE fine for someone so new to this. thats just my opinion though. and im arguing this in court.

    You knew before hand that you couldn't just stroll through town with a beer. This isn't some ground breaking, Earth shattering lesson for you.

    I understand the idea of having a few drinks before you go out. We did that all the time, and still do sometimes.

    That said, I'm not sashaying down 7th St. with a beer.

    I understand your budget. But if its as tight as you claim it is, with not room for an additional $250, then you shouldn't be careless about things like this. And now you'll learn, and it'll be something that, hopefully, you take with you down the line. It's a life lesson, not just a lesson about walking with beer. A lesson about fiscal responsibility, and about respect for your community.

    So, what do you think an appropriate fine would be in this case? Lets say you take this to court and argue that the fine is excessive. What is not excessive?

    I'm not saying that beer shouldn't be part of his budget, I'm just saying that his budget isn't as strict as he thinks it is. He needs to be thankful for what he has, stop whining about the fine and move on.

    I think a large part of the fine being so high is that, I assume, you're in a college town. Often they crack down on things like this. And not only does a $250 fine send a message to you, but it sends a message to everyone you know that you tell this story to. Perhaps one of your friends will think twice before walking with an open container now. "I remember Dingus McCloud got a $250 fine. Perhaps I'll drink this beer before I leave."

    Oh, I agree with that entirely. He's not choosing between having the power cut off or eating that week. He could easily trim his budget to make up for that fine.

    Got a click it or ticket right outside of SPAC a month ago... I went up there for the food and wine fest. Asshole cop pulls me over, and tells me i wasn't wearing my seatbelt when I was the entire time. I had it under my armit at the time, but whatever, it was still on. He refused to listen to me, refused to tell me how the hell he saw me (tinted windows, i don't know where he would get a clear view without standing on the side of the road) so he gave me the ticket and sent me on my merry way.

    So I wrote a letter with my ticket and mailed it in, basically a really night "go fuck yourself"

    I just got a response in the mail yesterday.

    "The case listed above has been dismissed, no further action is needed"

    HAAAAAAAAAAAAAAAAAA FUCK YOUUUUUUUUUUUUUUUUUUU

    Well, theoretically, drinking in public could be dangerous, which is why the law exists in the first place. But, I do agree speeding is generally far more dangerous. However, I think the current speeding fines are appropriate. As far as an open container ticket, I think subtracting $100 from the lowest possible speeding fine might be too low. That could make it as low as ~$50.

    Then raise the speeding ticket That's just my opinion anyway. But even doing 40MPH in a 30 zone is very dangerous to others.

    That could make it as low as $2.

    With the speed cameras now, you can easily get a speeding ticket for under $100.

    While I do maintain having an open container in public could potentially be dangerous to others, as alcohol does impare your judgement, I am in full agreeance the dollar amount for the fines should be reversed.
